Grundsatz: \u201elocal-first\u201c \u2013 deine Daten bleiben auf deinem Ger\u00e4t<\/h3>\n<p>SmartInboxPilot ist ein E-Mail-Programm, das nach dem Prinzip <strong>local-first<\/strong> arbeitet: Deine E-Mails, Konten und Einstellungen werden <strong>ausschlie\u00dflich lokal auf deinem Mac<\/strong> verarbeitet und gespeichert.<\/p>\n<ul>\n<li><strong>Wir (SeaSparks GmbH) erheben, speichern oder empfangen dabei keine personenbezogenen Daten von dir.<\/strong> Es gibt keinen Server von uns, an den die App Daten sendet.<\/li>\n<li>Es findet <strong>kein Tracking, keine Nutzungsanalyse, keine Telemetrie und keine Werbung<\/strong> statt. Die App enth\u00e4lt keine entsprechenden Bausteine.<\/li>\n<li>Deine Daten werden <strong>nicht<\/strong> an Dritte verkauft oder weitergegeben.<\/li>\n<\/ul>\n<h3>3. Netzwerkverbindungen und Empf\u00e4nger<\/h3>\n<p>Damit ein E-Mail-Programm funktioniert, verbindet sich die App mit <strong>Diensten, die du selbst nutzt bzw. ausw\u00e4hlst<\/strong> \u2013 nicht mit uns:<\/p>\n<ol>\n<li><strong>Dein E-Mail-Anbieter (IMAP\/SMTP).<\/strong> Zum Abrufen und Senden von Nachrichten verbindet sich die App direkt mit den Servern deines Anbieters. Die Verbindung ist per <strong>TLS verschl\u00fcsselt<\/strong>. Welche Daten dort verarbeitet werden, regelt die Datenschutzerkl\u00e4rung deines E-Mail-Anbieters.<\/li>\n<li><strong>Anmeldung \u00fcber OAuth (optional).<\/strong> Wenn du ein Konto bei Google (Gmail) oder Microsoft (Outlook\/Office 365) per \u201eAnmelden mit \u2026\u201c verbindest, kommuniziert die App mit den Anmelde-Servern des jeweiligen Anbieters (z.\u00a0B. <code>accounts.google.com<\/code>, <code>login.microsoftonline.com<\/code>). Es werden nur die f\u00fcr den Postfachzugriff n\u00f6tigen Berechtigungen angefragt.<\/li>\n<li><strong>Automatische Server-Erkennung beim Einrichten eines Kontos.<\/strong> Damit du nur E-Mail-Adresse und Passwort eingeben musst, versucht die App, die Server-Einstellungen automatisch zu ermitteln. Dazu kann die <strong>Domain deiner E-Mail-Adresse<\/strong> (der Teil hinter dem <code>@<\/code>) an einen Autoconfig-Dienst (z.\u00a0B. Mozilla ISPDB, <code>autoconfig.thunderbird.net<\/code>, bzw. <code>autoconfig.&lt;deine-domain&gt;<\/code>) \u00fcbermittelt werden. Zur Ermittlung der zust\u00e4ndigen Mailserver werden zudem DNS-Abfragen (MX-\/SRV-Eintr\u00e4ge der Domain) \u00fcber einen <strong>DNS-over-HTTPS-Anbieter (Cloudflare, ersatzweise Google)<\/strong> durchgef\u00fchrt. Es werden dabei <strong>keine Passw\u00f6rter und keine E-Mail-Inhalte<\/strong> \u00fcbertragen.<\/li>\n<li><strong>Externe Inhalte in E-Mails.<\/strong> Bilder und Schriften aus fremden Quellen in HTML-Mails werden <strong>standardm\u00e4\u00dfig blockiert<\/strong> und erst geladen, wenn du dies je Nachricht ausdr\u00fccklich erlaubst (Schutz vor Z\u00e4hl-\/Tracking-Pixeln). Beim Nachladen wird die jeweilige Fremd-Ressource von ihrem Server abgerufen.<\/li>\n<li><strong>Bereitstellung \u00fcber den Apple App Store \/ TestFlight.<\/strong> Der Bezug und die Aktualisierung der App laufen \u00fcber Apple. Dabei verarbeitet <strong>Apple<\/strong> Daten nach Apples eigenen Datenschutzbestimmungen; darauf haben wir keinen Einfluss.<\/li>\n<\/ol>\n<h3>5. KI-Funktionen (on-device)<\/h3>\n<p>SmartInboxPilot kann dir optional beim Verfassen von Antworten helfen und Mails klassifizieren. Diese KI-Funktionen laufen <strong>vollst\u00e4ndig on-device<\/strong> \u00fcber die von Apple bereitgestellten Modelle (Apple Intelligence) direkt auf deinem Mac. F\u00fcr diese Verarbeitung <strong>verlassen keine Inhalte dein Ger\u00e4t<\/strong> und werden <strong>nicht<\/strong> an SeaSparks \u00fcbermittelt. Die KI-Funktionen sind <strong>standardm\u00e4\u00dfig deaktiviert<\/strong> und m\u00fcssen von dir ausdr\u00fccklich eingeschaltet werden.<\/p>\n<h3>6. Rechtsgrundlagen<\/h3>\n<p>Soweit im Zusammenhang mit der App \u00fcberhaupt eine Verarbeitung personenbezogener Daten durch uns in Betracht kommt, st\u00fctzt sie sich auf <strong>Art. 6 Abs. 1 lit. b DSGVO<\/strong> (Bereitstellung der von dir angeforderten App-Funktionen) sowie auf <strong>Art. 6 Abs. 1 lit. f DSGVO<\/strong> (berechtigtes Interesse an einer funktionsf\u00e4higen, sicheren und datensparsamen Software). Da die Verarbeitung ausschlie\u00dflich lokal auf deinem Ger\u00e4t stattfindet und wir keine Daten empfangen, ist unsere Rolle als Verantwortlicher entsprechend begrenzt.<\/p>\n<h3>7. Speicherdauer und L\u00f6schung<\/h3>\n<ul>\n<li>Deine Daten bleiben <strong>so lange auf deinem Ger\u00e4t gespeichert, wie du es m\u00f6chtest<\/strong>.<\/li>\n<li><strong>Ein Konto entfernen:<\/strong> \u00dcber die App gel\u00f6schte Konten werden mitsamt ihrem lokalen Zwischenspeicher, ihren Einstellungen und ihren im Schl\u00fcsselbund hinterlegten Zugangsdaten vom Ger\u00e4t entfernt. Dein Postfach beim Anbieter bleibt davon unber\u00fchrt.<\/li>\n<li><strong>App deinstallieren:<\/strong> Beim Entfernen der App werden die lokal gespeicherten App-Daten gel\u00f6scht.<\/li>\n<\/ul>\n<h3>8. Deine Rechte<\/h3>\n<p>Nach der DSGVO stehen dir gegen\u00fcber dem Verantwortlichen grunds\u00e4tzlich die Rechte auf <strong>Auskunft (Art. 15), Berichtigung (Art. 16), L\u00f6schung (Art. 17), Einschr\u00e4nkung der Verarbeitung (Art. 18), Daten\u00fcbertragbarkeit (Art. 20)<\/strong> sowie ein <strong>Widerspruchsrecht (Art. 21)<\/strong> zu. Au\u00dferdem hast du das Recht, dich bei einer <strong>Datenschutz-Aufsichtsbeh\u00f6rde<\/strong> zu beschweren.<\/p>\n<p>Da wir selbst <strong>keine personenbezogenen Daten \u00fcber dich speichern<\/strong>, k\u00f6nnen wir zu deinen lokal bzw. bei deinem E-Mail-Anbieter gespeicherten Daten in der Regel keine Auskunft erteilen \u2013 diese verwaltest du direkt in der App bzw. bei deinem Anbieter. F\u00fcr Anfragen zu dieser Erkl\u00e4rung erreichst du uns unter der in Abschnitt 1 genannten Adresse.<\/p>\n<h3>9. Daten\u00fcbermittlung in Drittl\u00e4nder<\/h3>\n<p>Durch SeaSparks findet <strong>keine<\/strong> \u00dcbermittlung personenbezogener Daten in Drittl\u00e4nder statt. Verbindungen zu deinem E-Mail-Anbieter, zu OAuth-Anmeldediensten oder zu Apple erfolgen durch dich bzw. das Betriebssystem; f\u00fcr deren etwaige Drittland\u00fcbermittlungen gelten die Datenschutzbestimmungen der jeweiligen Anbieter.<\/p>\n<h3>10. \u00c4nderungen dieser Datenschutzerkl\u00e4rung<\/h3>\n<p>Wir passen diese Erkl\u00e4rung an, wenn sich die App oder die rechtlichen Rahmenbedingungen \u00e4ndern. Es gilt jeweils die hier ver\u00f6ffentlichte, mit Datum versehene Fassung.<\/p>\n<h3>11. Principle: \u201clocal-first\u201d \u2013 your data stays on your device<\/h3>\n<p>SmartInboxPilot is an e-mail program that works on a <strong>local-first<\/strong> basis: your e-mails, accounts and settings are processed and stored <strong>exclusively locally on your Mac<\/strong>.<\/p>\n<ul>\n<li><strong>We (SeaSparks GmbH) do not collect, store or receive any personal data from you in the process.<\/strong> There is no server of ours to which the app sends data.<\/li>\n<li>There is <strong>no tracking, no usage analytics, no telemetry and no advertising<\/strong>. The app contains no such components.<\/li>\n<li>Your data is <strong>not<\/strong> sold or passed on to third parties.<\/li>\n<\/ul>\n<h3>3. Network connections and recipients<\/h3>\n<p>For an e-mail program to work, the app connects to <strong>services that you use or choose yourself<\/strong> \u2013 not to us:<\/p>\n<ol>\n<li><strong>Your e-mail provider (IMAP\/SMTP).<\/strong> To retrieve and send messages, the app connects directly to your provider\u2019s servers. The connection is <strong>encrypted via TLS<\/strong>. What data is processed there is governed by your e-mail provider\u2019s privacy policy.<\/li>\n<li><strong>Sign-in via OAuth (optional).<\/strong> If you connect an account with Google (Gmail) or Microsoft (Outlook\/Office 365) via \u201cSign in with \u2026\u201d, the app communicates with the respective provider\u2019s sign-in servers (e.g. <code>accounts.google.com<\/code>, <code>login.microsoftonline.com<\/code>). Only the permissions required for mailbox access are requested.<\/li>\n<li><strong>Automatic server detection when setting up an account.<\/strong> So that you only need to enter your e-mail address and password, the app attempts to determine the server settings automatically. To do this, the <strong>domain of your e-mail address<\/strong> (the part after the <code>@<\/code>) may be sent to an autoconfig service (e.g. the Mozilla ISPDB, <code>autoconfig.thunderbird.net<\/code>, or <code>autoconfig.&lt;your-domain&gt;<\/code>). To find the responsible mail servers, DNS queries (the domain&#8217;s MX\/SRV records) are also performed via a <strong>DNS-over-HTTPS provider (Cloudflare, with Google as a fallback)<\/strong>. <strong>No passwords and no e-mail content<\/strong> are transmitted in the process.<\/li>\n<li><strong>External content in e-mails.<\/strong> Images and fonts from external sources in HTML mails are <strong>blocked by default<\/strong> and only loaded once you expressly allow it for an individual message (protection against counting\/tracking pixels). When loaded, the respective external resource is retrieved from its server.<\/li>\n<li><strong>Distribution via the Apple App Store \/ TestFlight.<\/strong> Downloading and updating the app runs through Apple. In doing so, <strong>Apple<\/strong> processes data according to Apple\u2019s own privacy policy, over which we have no influence.<\/li>\n<\/ol>\n<h3>5. AI features (on-device)<\/h3>\n<p>SmartInboxPilot can optionally help you compose replies and classify mails. These AI features run <strong>entirely on-device<\/strong> using the models provided by Apple (Apple Intelligence) directly on your Mac. For this processing <strong>no content leaves your device<\/strong> and it is <strong>not<\/strong> transmitted to SeaSparks. The AI features are <strong>disabled by default<\/strong> and must be explicitly enabled by you.<\/p>\n<h3>6. Legal bases<\/h3>\n<p>Insofar as any processing of personal data by us takes place in connection with the app at all, it is based on <strong>Art. 6(1)(b) GDPR<\/strong> (provision of the app functions you requested) as well as <strong>Art. 6(1)(f) GDPR<\/strong> (legitimate interest in functional, secure and data-minimizing software). Since the processing takes place exclusively locally on your device and we do not receive any data, our role as controller is correspondingly limited.<\/p>\n<h3>7. Storage duration and deletion<\/h3>\n<ul>\n<li>Your data remains stored on your device <strong>for as long as you wish<\/strong>.<\/li>\n<li><strong>Removing an account:<\/strong> Accounts deleted via the app are removed from the device together with their local cache, their settings and the credentials stored in the Keychain. Your mailbox at the provider remains unaffected.<\/li>\n<li><strong>Uninstalling the app:<\/strong> When the app is removed, the locally stored app data is deleted.<\/li>\n<\/ul>\n<h3>8. Your rights<\/h3>\n<p>Under the GDPR you generally have the rights to <strong>access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20)<\/strong> vis-\u00e0-vis the controller, as well as a <strong>right to object (Art. 21)<\/strong>. You also have the right to lodge a complaint with a <strong>data protection supervisory authority<\/strong>.<\/p>\n<p>Since we ourselves <strong>do not store any personal data about you<\/strong>, we are generally unable to provide information about the data stored locally or at your e-mail provider \u2013 you manage this data directly in the app or with your provider. For inquiries regarding this policy you can reach us at the address given in Section 1.<\/p>\n<h3>9. Transfers to third countries<\/h3>\n<p>No transfer of personal data to third countries takes place through SeaSparks. Connections to your e-mail provider, to OAuth sign-in services or to Apple are made by you or by the operating system; the privacy policies of the respective providers apply to any third-country transfers of theirs.<\/p>\n<h3>10. Changes to this privacy policy<\/h3>\n<p>We will adapt this policy if the app or the legal framework changes. The version published here, marked with a date, applies in each case.<\/p>\n<h3>11.
